Date:9/17/2013

ESTERO, Fla., Sept. 17, 2013 /PRNewswire/ -- Vision Pharma, LLC has initiated a civil action against Sunrise Pharmaceutical, Inc. of Rahway, New Jersey in U.S. District Court for the District of New Jersey, Trenton Division. The nine-count lawsuit seeks to recover at least $3 million from Sunrise Pharmaceutical, plus statute-imposed, mandatory treble damages and attorney fees pursuant to NJ Stat. Ann. § 56:8-19, stemming from Sunrise Pharmaceutical's defective manufacture of certain drug products deemed adulterated and unsalable by the U.S. Food & Drug Administration (FDA) as well as Sunrise Pharmaceutical's willful sale of said adulterated drugs to Vision Pharma without notice of the FDA's investigations and determinations.  The case is styled Vision Pharma, LLC v. Sunrise Pharmaceutical Inc., C.A. No. 2:13-cv-04692-CCC-JAD and is now pending before the Hon. Claire C. Cecchi.

A full list of the nine (9) causes of action asserted by Vision Pharma upon which it seeks relief from the U.S. District Court is as follows:

Count 1:  Violation of New Jersey Consumer Fraud Act
Count 2:  Breach of Contract
Count 3:  Willful Breach of Implied Warranty of Merchantability
Count 4:  Breach of Implied Warranty of Fitness for a Particular Purpose
Count 5:  Breach of Covenant of Good Faith and Fair Dealing

"It is very unfortunate that we had to file suit against Sunrise Pharmaceutical after numerous attempts to resolve these issues amicably; however, the severe damage they caused our company left this as the only option.  We are certainly prepared for a trial by jury and taking this case to the end for a well-deserved victory," said Sander S. Busman, Founder, President & CEO, Vision Pharma.  Vision Pharma is being represented by lead counsel Cameron S. Reuber, Esq. and a team of attorneys at Leason Ellis LLP.
