Behandlungsbefürworter fechten Patent für neues Hepatitis C Medikament an

NEW YORK, 25. November 2013 /PRNewswire/ -- Die Open Society Foundations begrüßten heute die Anfechtung durch die Initiative for Medicines, Access & Knowledge [Initiative für Medikamente, Zugang & Wissen] eines Patentantrags von Gilead Science in Indien für das neue Medikament Sofosbuvir.

Die Anfechtung, die im Kolkata Patent Office eingereicht wurde, würde im Erfolgsfalle dazu führen, dass Gilead bei Sofosbuvir kein Monopol für die Herstellung und Preisgestaltung hat. Damit könnten indische Hersteller eine billigere generische Version des Medikaments produzieren. Dies wäre auch ein erster Schritt in Richtung Verfügbarkeit in andern Ländern mit niedrigen und mittleren Einkommen.

Behandlungen mit Sofosbuvir sind kürzer als andere, die Heilungsrate ist höher, es kann oral eingenommen werden und es wird besser toleriert. Diese Vorteile sind jedoch kein Grund für die Erteilung eines Patents. Das indische Gesetz sieht vor, dass Produkte, die Varianten bestehender chemischer Verbindungen sind, nicht patentiert werden können.

„Sofosbuvir ist auf molekularer Ebene für die Gewährung eines Patents nicht innovativ genug", sagt Els Torreele, Direktor der Initiative für den Zugang zu wichtigen Medikamenten der Open Society Foundations. „Es handelt sich hier um unterschiedliche Auffassungen, ob Gewinne oder das Leben von Patienten die Entscheidung bei Hepatitis C bestimmen."

Sofosbuvir wird voraussichtlich in den kommenden Wochen in den USA und in Europa zugelassen, wobei die Behandlungskosten im Bereich von $ 80.000 liegen. Da etwa 90 % der Patienten mit Hepatitis C in Ländern mit niedrigen und mittleren Einkommen leben, liegen für sie die Kosten der Behandlung außer Reichweite.
