High Court Upholds HIV Afflicted BSF Jawan's Termination

The Delhi High Court today upheld the decision of the BSF to terminate the services of a BSF personnel who was found suffering from 50 percent disability on account of contracting the dreaded HIV ailment. //

But the court clarified that the termination was being upheld on the ground that the victim was disabled due to the ailment and not because of his contracting HIV.

A Division Bench of Justice Mukul Mudgal and Justice H R Malhotra, however, castigated the BSF for making public disclosure of the victim's disease and refusing to treat him.

The Bench also ruled that the jawan was entitled to receive his wages and other emoluments from July 20, 1995, the day he was diagnosed with HIV upto October 10, 1997 when his services were terminated.
