First Gay Man Prosecuted On the Charges of Infecting His Lover with HIV

Mark James, of Burgess Hill, West Sussex was prosecuted for intentionally infecting his live in lover with HIV and a warrant was issued to arrest him.//

He failed to appear at court and the Judge Jonathan Lowen told Isleworth Crown Court that the 47-year-old businessman would be sentence in his absence. He is facing a lengthy jail sentence for inflicting bodily harm to his lover. James has admitted infecting his former partner with AIDS. Mark Gadsden, for the prosecution, said that James did not tell his former partner that he was previously diagnosed with HIV.

Detective Constable Elliott Toms said that James has behaved in a callous, reckless and misleading way. But now the victim has protracted a deadly infection and has gone through a traumatic experience. The victim’s health is also affected adversely by the proceedings. James is the first gay man to be prosecuted for infecting someone with HIV but there have been a number of heterosexual cases.
