Doctor Cleared Of Charges of Killing a baby

Dr Mohie El-Khadem of Prestbury Avenue, Newcastle-under-Lyme, Staffs, was found not guilty of killing baby Olivia Rowlings//. The doctor has been cleared of the manslaughter of a baby who died of head injuries eight hours after being born.

Jurors at Birmingham Crown Court took five hours to reach their verdict. Passing their decision to the judge they offered their sympathies to the family.

Dr El-Khadem an Egyptian by birth denied manslaughter through gross negligence, he told the court that he had not panicked while delivering the child using a suction device and forceps. He was led crying from the courtroom by a member of his legal team at the end of the trial on Wednesday.

Mr Battisby, the lawyer of Olivias parents, Julie & Neil Rowling, said that the couple, from Telford, were upset and disappointed with the verdict and felt badly let down by the 47-year-old medic. He said that Dr El-Khadem used a level of force during the delivery, which was described by a witness as hugely inappropriate.

Stating that Baby Olivia was born with significant bruising and swelling, with cuts to her face and ears, multiple skull fractures and a massive brain injury. Mr. Battisby told that the verdict does not diminish in any way the acknowledgement made by the trust in the civil claim for damages that the level of care had been negligent and unacceptable.

Mr and Mrs Rowlings had already been successful in claiming damages from the trust, which runs the hospital.
