The personal injury attorneys at d'Oliveira & Associates recently recovered a $150,000 settlement for one of their Newport clients(RI District Court-2nd Division Case: MI-11889). The client was injured when a transportation driver operating a car allegedly negligently hit the client who was crossing a driveway. The collision caused her to sustain a broken hip and ankle. Also, she continually complained of significant pain and endured several months of physical therapy after the surgery.

The client contacted the law offices of d'Oliveira & Associates, specifically Attorney Robin Gouveia, who brought a claim on her behalf and was able to get her a settlement at mediation of $150,000. “The client was on Supplemental Security Disability (SSI), which has an income and asset limit she could not exceed. If she received the full settlement, she would lose her monthly and Medicare benefits. We structured her settlement into monthly payments and kept the monthly income within the SSI limit, allowing her to maintain her Social Security benefit and Medicare.”

Attorney Paul d’Oliveira stated that ”Because the woman was on SSI this settlement was in her best interest and allowed her to get the most money she could without losing her SSI monthly income. Getting her a larger settlement would not have been in her best interest. I’m glad Attorney Gouveia has such extensive experience in not only auto accident cases but also in social security law as this woman needed good legal advice in both of these areas of the law.”

While this accident did not occur at a cross-walk or intersection like a majority of auto accidents involving pedestrians, it shows that the risk of serious injury for pedestrians is just as high in parking lots and driveways
