d'Oliveira & Associates Helps Newport Woman Receive $150,000 Settlement for Auto Accident; Case: MI-11889

The client was injured when a transportation driver operating a car allegedly negligently hit the client who was crossing a driveway. The collision caused her to sustain a broken hip and ankle. Also, she continually complained of significant pain and endured several months of physical therapy after the surgery.

If she received the full settlement, she would lose her monthly and Medicare benefits. We structured her settlement into monthly payments and kept the monthly income within the SSI limit, allowing her to maintain her Social Security benefit and Medicare.”

While this accident did not occur at a cross-walk or intersection like a majority of auto accidents involving pedestrians, it shows that the risk of serious injury for pedestrians is just as high in parking lots and driveways. In fact, it was reported by the National Highway Traffic Safety Administration that approximately 50,000 non-vehicle occupants (pedestrians) were killed in auto-accidents over a 9 year period. This number is a grim reminder that people are still at risk for injury or death in car accidents even when they are not in an automobile or even on the street sidewalk.
