Zoloft Lawsuits: Bernstein Liebhard LLP Notes More than 300 Claims Now Pending in Federal Zoloft Birth Defects Litigation

Bernstein Liebhard LLP notes that at least 330 Zoloft lawsuits are now pending in the federal multidistrict litigation established in U.S. District Court, Eastern District of Pennsylvania, for claims involving Zoloft birth defect allegations. On April 1st, the Court published two new Pretrial Orders on the Zoloft litigation’s website, one of which amends the previously established Joint Discovery and Scheduling Plan. The second Order posted by the Court governs the process for selection of the litigation’s Initial Discovery Group. Zoloft Birth Defects
Zoloft belongs to a class of drugs known as selective serotonin reuptake inhibitor (SSRI) antidepressants, and is used to treat major depression, obsessive-compulsive disorder, panic disorder, and anxiety disorders. In November 2006, the U.S. Food & Drug Administration (FDA) added warnings about a potential risk of persistent pulmonary hypertension in newborns (PPHN) from Zoloft and other SSRI antidepressants when taken after the 20th week of pregnancy.* A second study published in the British Medical Journal in September 2009 found that SSRI antidepressants like Zoloft increase the risk of heart defects when taken during the first trimester.**

Court documents indicate that the first trials in the federal Zoloft birth defect litigation will begin in October 2014. All of the Zoloft lawsuits pending in the Eastern District of Pennsylvania allege that use of Zoloft during pregnancy can increase the risk of delivering a child with severe birth defects, including pulmonary hypertension in newborns (PPHN), spina bifida and other neural tube defects, heart defects, abdominal defects, and club foot.
