Vaginal Mesh Mock Jury Trials Take Place In California

Attorney Stewart R. Albertson, along with several other law firms, recently spent two days in Riverside, California preparing for the first vaginal mesh sling case to be tried in the United States against American Medical Systems, Inc. The case, Carpenter v. American Medical Systems, Inc., Case No. CIVDS 1007094, is filed in the San Bernardino County Superior Court.

Mr. Albertson and his colleagues made arguments in front of several mock juries. “We presented a strong case from both the plaintiff’s side and the defense’s side” said Albertson. “We wanted these jurors to hear the best arguments from both sides so we could see how effective we would be at trial,” continued Albertson.

After the plaintiff and defense arguments were made, the juries deliberated. Each of the juries came up with a verdict. After each verdict the jurors discussed the case with the attorneys.

According to Albertson, the plaintiff in Carpenter v. American Medical Systems, a 47-year-old California patient, alleges she had the Monarc Subfascial Hammock surgically implanted at the Loma Linda University Medical Center in March 2008. Since March 2008, the patient has undergone ten surgeries where surgeons have attempted to take out the Monarc vaginal mesh and fix the extensive scarring that has occurred. The plaintiff alleges that she lives in constant pain and her career as a registered nurse is now over.
