The vaginal mesh lawyers at Bernstein Liebhard LLP report that a new Order has been issued in the federal litigation established in the U.S. District Court, Southern District of West Virginia for American Medical Systems pelvic mesh lawsuits that governs the production of previously-withheld documents. According to the April 29th Order, American Medical Systems has agreed to adopt guidelines that will minimize the number of documents withheld on claims of privilege or work product. American Medical Systems Vaginal Mesh Lawsuits
Court documents indicate that American Medical Systems was named in more than 5,000 vaginal mesh lawsuits filed in the Southern District of West Virginia as of March 2013. According to a May 7th article in The Wall Street Journal, Women’s Health Sales at Endo Health Solutions, the parent of American Medical Systems, declined 16% in the first quarter of 2013. The company attributed the decline to the September 2011 U.S. Food & Drug Administration (FDA) advisory committee meeting regarding the use of transvaginal mesh in pelvic organ prolapse.*
In July 2011, the FDA issued a public health alert stating there had been a five-fold increase in vaginal mesh complications reported to the agency. In the warning, the FDA also re-classified the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair as “not rare,” which was a change from the position it had taken previously.**
In addition to the American Medical Systems litigation, several other consolidated proceedings for vaginal mesh lawsuits are now underway in the Southern District of West Virginia, including: In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); and In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”), and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”). In addition, Mr. Grand was named Co-Liaison Counsel in two consolidated litigations underway in New Jersey’s Atlantic County Superior Court. He also served on the trial team for the first Ethicon mesh lawsuit trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff.
