Vaginal mesh lawsuits (http://www.mesh-lawyers.net/) involving Ethicon, Inc.’s Gynecare pelvic mesh products continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. According to a Pretrial Order dated August 12, 2013, the Court has scheduled eight telephonic discovery conferences to be held each Friday through September 23, 2013. The first of these conferences was held on August 16th, while the next is scheduled for August 23rd at 3:00 p.m. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327)

Ethicon Vaginal Mesh Lawsuits
Ethicon Inc.’s Gynecare mesh products have been named in a growing number of vaginal mesh lawsuits since October 2008, when the U.S. Food and Drug Administration (FDA) issued the first of two public health alerts to inform the public of the high rate of serious complications associated with the use of pelvic mesh to treat stress urinary incontinence and pelvic organ prolapse. Court documents indicate that more than 8,400 vaginal mesh lawsuits have been filed against Ethicon in the Southern District of West Virginia, all of which allege the company’s Gynecare products caused women to suffer serious complications, including mesh erosion, infections, chronic pain and scarring. Plaintiffs accuse the company of failing to provide adequate warnings to doctors and patients about the significant risk of serious vaginal mesh complications.
The Ethicon litigation is just one of several that have been established in that district for vaginal mesh lawsuits. Bernstein Liebhard LLP partner, Jeffrey S. Bard faces just over 800 claims filed in a second consolidated proceeding pending before the same judge. Mr. Grand has been named Co-Liaison Counsel in both litigations, and was a member of the trial team for the first Ethicon trial that concluded in March with an $11 million verdict for the plaintiff.
