Thousands of vaginal mesh lawsuit claims continue to move forward in federal litigations now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to a Pretrial Order issued by the Court on May 29th, parties in the litigations have reached an agreement regarding the delayed filing of claims and the application of the statute of limitations. According to the Order, the agreement will apply to four litigations underway in the Southern District of West Virginia: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“ MDL No. 2327”). Bernstein Liebhard LLP partner, Jeffrey S. Grand, serves on the Plaintiffs’ Steering Committee in all of these proceedings.

Vaginal Mesh Complications
Pelvic mesh devices used to treat pelvic organ prolapse and stress urinary incontinence have been the subject of a U.S. Food & Drug Administration (FDA) safety review since October 2008, when the agency warned that it had received more than 1,000 vaginal mesh complication reports during a three-year period. In July 2011, the FDA changed its stance on the frequency of injuries associated with prolapse repair, stating it no longer considered these complications to be rare. At that time, the agency revealed it had received more than 2,800 reports of vaginal mesh injuries since its 2008 communication.*
Court documents indicate that thousands of women have since filed transvaginal mesh lawsuits, all of which allege the manufacturers of the devices were negligent in designing the products, and failed to warn consumers of their serious risks. Thousands of additional transvaginal mesh claims involving products marketed by Ethicon Inc. and C.R. Bard have been consolidated in New Jersey Superior Court, Atlantic County, where Bernstein Liebhard LLP partner, Jeffrey, S.. Grand is serving as Co-Liaison Counsel.
