Vaginal Mesh Lawsuit News: Wright & Schulte LLC Commends Latest Transvaginal Mesh Settlement in C.R. Bard Litigation
Date:9/16/2013

Columbus, OH (PRWEB) September 17, 2013

Vaginal Mesh Lawsuit News: The attorneys at Wright & Schulte LLC are pleased with recent news out of New Jersey that C.R. Bard has reached a second vaginal mesh lawsuit settlement in a claim involving its Avaulta pelvic mesh. According to a report from Bloomberg News, the undisclosed settlement was reached in a Vaginal Mesh Lawsuit that had been tapped for the first bellwether trial in a consolidated litigation underway in Atlantic County Superior Court, where C.R. Bard is named a defendant in more than 800 transvaginal mesh lawsuit or bladder mesh lawsuits. According to court documents, the transvaginal mesh lawsuit trial was scheduled to start on September 23, 2013. (Virgil v. C.R. Bard Inc., ATL-L6917-10, Superior Court of New Jersey Law Division, Atlantic County)

This transvaginal mesh settlement comes just weeks after C.R. Bard agreed to another undisclosed settlement in a federally-filed transvaginal mesh lawsuit that was scheduled for trial in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. According to court documents, that settlement was reached just a week after the jury hearing the first Avaulta bellwether trial in the federal litigation awarded $2 million to the plaintiff. Wright & Schulte LLC, which represents numerous women in vaginal mesh lawsuit who have allegedly experienced painful vaginal mesh complications due to products manufactured by C.R. Bard and other companies, is encouraged by these recent developments, and believe they bode well for plaintiffs in similar transvaginal mesh lawsuits. The Firm is continuing to offer free legal evaluations to alleged victims of serious vaginal mesh complications. Data from the U.S. Food & Drug Administration (FDA) indicates that thousands of women with pelvic organ prolapse and stress urinary incontinence have had transvaginal mesh devices implanted to treat the disorders. In 2008 and 2011, the agency issued public health alerts regarding the growing number of vaginal mesh complications that had been reported to its adverse event database, especially in women who received transvaginal mesh to treat pelvic organ prolapse. According to the FDA, the most frequently reported transvaginal mesh complications include mesh erosion and shrinkage, chronic pain, infection, and pain during sexual intercourse.

According to Bloomberg News, tens of thousands of vaginal mesh lawsuits have been filed in courts around the country on behalf of women allegedly injured by these devices. In addition to the C.R. Bard litigation, several other multidistrict litigations are pending in the Southern District of West Virginia for transvaginal mesh lawsuits involving other manufacturers, including:

  •     In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (MDL No. 2325)
  •     In re: Boston Scientific Corp., Pelvic Repair System Products Liability Litigation (MDL No. 2326);
  •     In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (MDL No. 2327); and
  •     In Re: Coloplast Corp. Pelvic Support System Products Liability Litigation (MDL No. 2387).

So far, device manufacturers have lost every vaginal mesh lawsuit that has gone to trial. In July 2012, C.R. Bard was ordered to pay $3.6 million to another Avaulta plaintiff in a case that went to trial in California Superior Court. (Scott v. Kannappan, S-1500-CV-266034-WDE ) In March of this year, the New Jersey Superior Court jury hearing the nation’s first trial of an Ethicon Inc. transvaginal mesh lawsuit awarded more than $11 million to a woman injured by the Gynecare Prolift device. (Gross v. Gynecare Inc., Atl-L-6966-10)
