it (Cisson v. C.R. Bard Inc., Case No. 2:11-cv-00195) has concluded a somewhat dramatic trial process, as the first attempt to litigate this case ended with a mistrial in July 2013 when Judge Goodwin ruled that a witness’ testimony was prejudicial. The jury’s ruling in this bellwether case will be critical to in establishing future trends for the more than 5,000 bladder mesh lawsuits that have already been filed against C.R. Bard in the U.S. District Court of West Virginia (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, 10-md-02187). Bellwether Mesh Lawsuit Alleges Bard’s Negligence

According to the complaint for this first bellwether bladder mesh lawsuit (Cisson v. C.R. Bard Inc., Case No. 2:11-cv-00195), the plaintiff had Bard’s Avaulta Plus implanted in 2009 to treat her pelvic organ prolapse and stress urinary incontinence. After developing some serious complications, including internal bleeding and bladder spasms, the plaintiff was forced to undergo multiple surgeries to extract the defective mesh sling. During the trial, the plaintiff’s lawyers argued that C.R. Bard was aware that its bladder mesh posed a serious risk to women and that, despite this fact, the company failed to warn the public about these risks.
