Vaginal Mesh Lawsuit News: Jury Awards $2 Million to Plaintiff in First C.R. Bard Vaginal Mesh Lawsuit, Reports Alonso Krangle LLP
Date:8/16/2013

Melville, NY (PRWEB) August 16, 2013

In recent vaginal mesh lawsuit news, C.R. Bard, the manufacturer of the Avaulta line of vaginal mesh devices, has been ordered by a jury to pay a Georgia woman $2 million for her serious bladder mesh injuries. This vaginal mesh lawsuit verdict includes $250,000 in compensatory damages and $1.75 million in punitive damages. The plaintiff’s vaginal mesh injuries reportedly included perforation to her internal organs, vaginal scarring, pelvic pain and pain during intercourse. According to court documents, the plaintiff’s vaginal mesh complications were so debilitating that she suffered significant negative impacts to her quality of life and eventually had to have the mesh removed.

The verdict in the two-week trial for this vaginal mesh lawsuit (Cisson v. C.R. Bard Inc., Case No. 2:11-cv-00195) was reached after the jury had reportedly deliberated for around 12 hours. It marks the first verdict in the first bellwether case to go to trial of the four selected bellwether cases that will be litigated back-to-back in the U.S. District Court, Southern District of West Virginia and that will be presided over by Judge Joseph Goodwin. The second bellwether bladder mesh lawsuit filed against C.R. Bard is set to start trial on August 19, 2013. [nj.com/business/index.ssf/2013/08

The recent verdict in this Bard vaginal mesh lawsuit (Cisson v. C.R. Bard Inc., Case No. 2:11-cv-00195) has concluded a somewhat dramatic trial process, as the first attempt to litigate this case ended with a mistrial in July 2013 when Judge Goodwin ruled that a witness’ testimony was prejudicial. The jury’s ruling in this bellwether case will be critical to in establishing future trends for the more than 5,000 bladder mesh lawsuits that have already been filed against C.R. Bard in the U.S. District Court of West Virginia (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, 10-md-02187). Bellwether Mesh Lawsuit Alleges Bard’s Negligence

According to the complaint for this first bellwether bladder mesh lawsuit (Cisson v. C.R. Bard Inc., Case No. 2:11-cv-00195), the plaintiff had Bard’s Avaulta Plus implanted in 2009 to treat her pelvic organ prolapse and stress urinary incontinence. After developing some serious complications, including internal bleeding and bladder spasms, the plaintiff was forced to undergo multiple surgeries to extract the defective mesh sling. During the trial, the plaintiff’s lawyers argued that C.R. Bard was aware that its bladder mesh posed a serious risk to women and that, despite this fact, the company failed to warn the public about these risks.
