Vaginal Mesh Lawsuit News: Federal Judge Overseeing American Medical Systems Litigation Sets Order of First Bellwether Trials, Bernstein Liebhard LLP Reports
Date:12/13/2013

New York, New York (PRWEB) December 13, 2013

Thousands of vaginal mesh lawsuits (http://www.transvaginalmeshlawsuitclaims.com/) involving products manufactured by American Medical Systems, Inc. continue to move forward in a federal multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to a Pretrial Order issued on December 11, 2013, the judge overseeing the proceeding has established the trial order for its first four bellwether cases. The first of those four trials will begin on April 7, 2014. (In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325)

“We are representing numerous women in transvaginal mesh lawsuits that have been filed in this proceeding. The bellwether trials will provide insight into how juries might rule in similar claims pending against American Medical Systems,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. Firm partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee in the American Medical Systems litigation. Bernstein Liebhard LLP continues to offer free legal consultations to alleged victims of serious vaginal mesh complications.

Vaginal Mesh Lawsuits
Court documents indicate that more than 12,000 vaginal mesh lawsuits have been filed against American Medical Systems in the federal litigation underway in West Virginia. All of the claims allege that recipients of the company’s pelvic mesh devices used to treat pelvic organ prolapse and stress urinary incontinences suffered painful and debilitating vaginal mesh complications.

The American Medical Systems litigation is just one of several established in the Southern District of West Virginia for transvaginal mesh lawsuits. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees in four additional proceedings: Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and In re: Ethicon, Inc. (MDL No. 2327). According to court documents, more than 40,000 transvaginal mesh lawsuits involving these and other manufacturers are now pending in the federal litigations.

According to court documents, vaginal mesh lawsuits began to mount after the U.S. Food & Drug Administration (FDA) issued a Public Health Alert in October 2010 regarding the risk of serious injuries associated with transvaginal mesh devices. In 2011, the FDA issued a second alert, warning that it no longer considered vaginal mesh complications associated with the use of pelvic mesh in prolapse repair to be rare.

Women who have allegedly suffered debilitating and painful vaginal mesh complications may be entitled to compensation for medical bills, lost wages, pain and suffering, and more.
