U.S. Federal Panel Vacates Order to Transfer Mirena Lawsuit to New York Litigation, Bernstein Liebhard LLP Reports

An order to transfer a Mirena lawsuit (http://www.themirenalawsuitcenter.com/) to the federal proceeding underway in the U.S. District Court, Southern District of New York has been vacated by a federal panel who decided that its claims were not factually similar to those already filed in the litigation, Bernstein Liebhard LLP reports.

According to an order issued on October 16th by the U.S. Judicial Panel on Multidistrict Litigation (JPML), the case will no longer be transferred because it fails to allege spontaneous migration of the IUD and/or uterine perforations; claims which are included in all other federally-filed Mirena lawsuits involved in the proceeding. A Motion to vacate the Panel’s order to transfer this complaint was originally filed by Bayer Healthcare Pharmaceuticals Inc.

Court records indicate that dozens of Mirena lawsuits alleging complications stemming from spontaneous migration of the IUD are currently pending in the federal New York litigation. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
