Tylenol Lawsuit News: New Jersey Supreme Court Refuses Multicounty Case Consolidation, Rottenstein Law Group LLP Reports

The New Jersey Supreme Court recently denied a motion by drugmakers Johnson & Johnson and McNeil-PPC to consolidate statewide Tylenol lawsuits, according to court documents. The court denied the Tylenol-makers’ motion to consolidate lawsuits stemming from severe liver damage allegations in Middlesex County Superior Court, according to the NJ Supreme Court’s Notice.* There are more than a dozen Tylenol lawsuits in New Jersey, according to court documents, mostly in Atlantic County. Tylenol lawsuits were consolidated, however, at the federal level (In re: Tylenol-Acetaminophen Marketing, Sales Practices and Products Liability Litigation; MDL-2436, U.S. District Court for the Eastern District of Pennsylvania, Judicial Panel on Multidistrict Litigation).

“Case consolidations such as ‘multicounty’ or ‘multidistrict litigations’ are not class actions,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “Instead, they are methods for pretrial efficiency when cases share common causes for suit. One major difference is that consolidated cases still have the potential for their own individual trials and possible damages awards.”
