Transvaginal Mesh Lawyers at Bernstein Liebhard LLP Note Issuance of New Order in Federal Ethicon Mesh Litigation

l claims have been filed in a consolidated litigation underway in New Jersey’s Atlantic County Superior Court. In March, the nation’s first trial involving an Ethicon product concluded in the New Jersey litigation, with the jury awarding more than $11 million to the Plaintiff, Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel in that litigation, and also served on the trial team for that case. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10) In addition, Mr. Grand is Co-Lead Counsel in a second vaginal mesh litigation underway in Atlantic County Superior Court for surgical mesh lawsuits involving products manufactured by C.R. Bard. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)

Additional transvaginal mesh litigations have also been established in the Southern District of West Virginia, including: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); and In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”). Mr. Grand is also serving on the Plaintiffs’ Steering Committee in these four proceedings.

The litigation surrounding vaginal mesh products used to treat prolapse and incontinence has been growing since July 2011, when the U.S. Food and Drug Administration (FDA) issued a public health alert stating there had been a five-fold increase in transvaginal mesh problems reported to the agency. In the warning, the FDA also re-classified the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair as “not rare,” which was a change from the position it had taken previously.*
