Transvaginal mesh lawsuit claims involving Ethicon Inc.’s Gynecare pelvic mesh products continue to move forward in a consolidated litigation underway in New Jersey’s Atlantic County Superior Court, Bernstein Liebhard LLP reports. Most recently, a Case Management Conference was held in the Ethicon mesh litigation on May 22nd to address issues stemming from the proceeding’s first trial, which concluded in March with an award of more than $11 million for the Plaintiff. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel in the Ethicon litigation, and was a member of the Plaintiff’s trial team. Transvaginal Mesh Lawsuits
The vaginal mesh devices named in Ethicon mesh lawsuits are used to surgically repair pelvic organ prolapse and stress urinary incontinence. Transvaginal mesh lawsuits have been mounting in courts throughout the country since July 2011, when the U.S. Food & Drug Administration (FDA) warned that there had been a five-fold increase in vaginal mesh complications reported to the agency. At the same time, the FDA also modified its stance on the frequency of mesh injuries associated with prolapse repair, stating that it no longer considered the problems to be rare.*
In addition to his work on the Ethicon mesh litigation in New Jersey, Mr. Grand is also serving as Co-Liaison Counsel in a second litigation underway in Atlantic County Superior court for transvaginal mesh lawsuits involving products marketed by C.R. Bard, Inc. Court documents indicate that the first bellwether trial in the New Jersey C.R. Bard litigation will begin on September 23, 2013, and will involve a vaginal mesh device used to treat pelvic organ prolapse. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
Mr. Grand is also a member Plaintiffs’ Steering Committees in four litigations now underway in U.S. District Court, Southern District of West Virginia: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”). The first trial in that proceeding, which will involve a product manufactured by C.R. Bard, is scheduled to begin in June.
