Transvaginal Mesh Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Issuance of New Order in Federal C.R. Bard Litigation

trial was voluntarily dismissed by the Plaintiff. The fourth transvaginal mesh lawsuit selected for a bellwether trial was supposed to go before a jury on January 10, 2014, but court documents filed in the case indicate that it has been postponed indefinitely.

C.R. Bard is just one of several manufacturers named in claims that are pending in the Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees for the following federal litigations: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.

Mr. Grand was also named Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon mesh lawsuits in New Jersey’s Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March with an $11 million verdict for the Plaintiff.
