Transvaginal Mesh Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Issuance of New Order in Federal C.R. Bard Litigation

The federal multidistrict litigation established for transvaginal mesh lawsuits ( filed against C.R. Bard, Inc. continues to move forward in the U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. On January 9, 2014, the Court issued a Stipulated Protective Order pertaining to non-party documents produced in accordance with certain subpoenas issued by C.R. Bard. (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187)

“We have filed numerous cases in this proceeding on behalf of women who allegedly suffered serious vaginal mesh complications following implantation of transvaginal mesh devices marketed by C.R. Bard. We are pleased to see this litigation moving forward,” resenting the victims of defective drugs and medical devices. Firm partner, Jeffrey S. Grand, is a member of the Plaintiffs' Steering Committee in the federal C.R. Bard litigation. Bernstein Liebhard LLP continues to offer free legal evaluations to women who allegedly suffered mesh erosion, chronic pain, infections, and other complications following implantation of devices manufactured by C.R. Bard, Inc., as well as American Medical Systems, Inc., Ethicon, Inc. and Boston Scientific Corp.

Vaginal Mesh Lawsuits
According to court documents, more than 6,300 vaginal mesh lawsuits have been filed against C.R. Bard in the Southern District of West Virginia. The proceeding’s first bellwether trial concluded in August, with the jury awarding $2 million in compensatory and punitive damages to the Plaintiff. Court records further indicate that what was to have been the litigation’s second bellwether trial settled on the day the trial was set to begin, while the third case set for a bellwether trial was voluntarily dismissed by the Plaintiff. The fourth transvaginal mesh lawsuit selected for a bellwether trial was supposed to go before a jury on January 10, 2014, but court documents filed in the case indicate that it has been postponed indefinitely.

C.R. Bard is just one of several manufacturers named in claims that are pending in the Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.

Mr. Grand was also named Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon mesh lawsuits in New Jersey’s Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March with an $11 million verdict for the Plaintiff.
