Transvaginal Mesh Lawsuits: Bernstein Liebhard LLP Notes Upcoming Case Management Conference in New Jersey Ethicon Pelvic Mesh Litigation

New York, New York (PRWEB) May 18, 2013

Transvaginal mesh lawsuits involving Ethicon Inc.’s Gynecare pelvic mesh products continue to move forward in a consolidated litigation underway in New Jersey’s Atlantic County Superior Court, Bernstein Liebhard LLP reports. According to a notice on the Court’s website, the next Case Management Conference in the Ethicon pelvic mesh litigation will be held on Wednesday, May 22nd. Court records indicate that 2,755 complaints have been filed in the proceeding on behalf of women who suffered serious injuries allegedly due to transvaginal mesh failure associated with Ethicon device.

“We continue to receive inquiries from women who have allegedly suffered serious injuries following the implantation of transvaginal mesh to treat pelvic organ prolapse and stress urinary incontinence. We are pleased to see that this litigation is continuing to move forward,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. Bernstein Liebhard LLP is representing numerous women in the New Jersey Ethicon litigation, where Firm partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel. The Firm continues to offer free legal evaluations to alleged victims of Ethicon transvaginal mesh failure.

Ethicon Transvaginal Mesh Lawsuits
In March, the nation’s first trial involving Ethicon Gynecare mesh complications concluded in the New Jersey litigation, with the jury awarding $3.35 million in compensatory damages, plus $7.76 million in punitive damages, to a woman who experienced transvaginal mesh failure associated with the Gynecare Prolift device. Bernstein Liebhard LLP partner, Jeffrey S. Grand, served on the trial team for the case. (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey).

Mr. Grand is also serving as Co-Liaison Counsel in a second litigation underway in New Jersey Superior Court, Atlantic County, for vaginal mesh lawsuits involving products marketed by C.R. Bard, Inc. Court documents indicate that the first bellwether trial in the New Jersey C.R. Bard litigation will begin on September 23, 2013, and will involve a vaginal mesh device used to treat pelvic organ prolapse. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)

Mr. Grand is also a member Plaintiffs’ Steering Committees in four vaginal mesh litigation’s now underway in U.S. District Court, Southern District of West Virginia: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”).

According to the U.S. Food & Drug Administration (FDA), the most common reasons for transvaginal mesh failure include mesh erosion through vaginal tissue, infection, pain, and urinary problems. In a July 2011 alert, the FDA warned that there had been a five-fold increase in transvaginal mesh problems reported to the agency. At the same time, the FDA also modified its stance on the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair, stating that it no longer considered the problems to be rare.*

Victims of alleged transvaginal injuries may be entitled to compensation for their medical bills, pain and suffering, and other injuries. A wealth of information regarding vaginal mesh lawsuits can be found at Bernstein Liebhard's website. To learn more, please call 800-511-5092.
