Thousands of transvaginal mesh lawsuit

The Court recently issued orders on September 13, 2013 addressing various filing protocols as these lawsuits continue to move forward. Court documents indicate that more than 20,000 vaginal mesh lawsuits involving a number of manufacturers are pending in consolidated proceedings underway in the Southern District of West Virginia. In addition to his work in the litigations established for American Medical Systems and Ethicon claims, Mr. Grand is also a member of the Plaintiffs’ Steering Committees for In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation, MDL No. 2326, and In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187.
On August 15th, the federal litigation’s first trial of a transvaginal mesh lawsuit concluded when a woman injured by a C.R. Bard’s Avaulta Plus device was awarded $2 million. (Cisson v. C.R. Bard Inc., 11-cv-00195) The litigation’s second C.R. Bard trial was to get underway the following week, but an undisclosed settlement was reached in the case just prior to the start of opening arguments. (Queen v. C.R. Bard Inc., 11-cv-00012)
In addition to the proceedings underway in West Virginia, thousands of vaginal mesh lawsuits are pending against Ethicon and C.R. Bard in two multicounty litigations underway in New Jersey’s Atlantic County Superior Court, where Mr. Grand is serving as Co-Liaison Counsel. He was also a member of the Plaintiff’s trial team for the Ethicon litigation’s first trial. That case ended in March with an $11 million verdict for a woman who suffered transvaginal mesh complications due to the company’s Gynecare Prolift device.
