Transvaginal Mesh Lawsuit News: New CR Bard Mesh Trial Scheduled for Aug. 19, Rottenstein Law Group LLP Reports

On the heels of its loss in the first federal vaginal mesh bellwether trial, CR Bard is scheduled to face a new trial on Aug. 19 in federal court in Charleston, West Virginia, according to court documents. The Rottenstein Law Group LLP, a transvaginal mesh law firm, notes that the first trial’s verdict was more than $2 million in compensatory and punitive damages.*

Plaintiffs Greg and Wanda Queen are suing Bard, alleging they suffered injury from Wanda’s Avaulta transvaginal mesh implant, according to court documents (Queen et al v. C. R. Bard, Inc.; 2:11-cv-00012, MDL-2187, U.S. District Court for the Southern District of West Virginia). Judge Joseph R. Goodwin is scheduled to preside over this bellwether trial, as he did with the first one.

“Past trial results don’t predict future verdicts, but it is important to note that so far mesh case juries have found in favor of the plaintiffs,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “These devices have been found to cause harm to women who have received implantations to treat urinary stress incontinence and pelvic organ prolapse.”

Women who have filed vaginal mesh lawsuits allege that the devices have caused them several serious adverse side effects since implantation, including vaginal erosion, according to court documents.

Several mesh manufacturers are also defendants in several thousands of federal lawsuits consolidated for pretrial efficiency.** Other recent vaginal mesh awards included a 2012 verdict in California against Bard which resulted in a $5.5 million damages award*** to the plaintiff and a 2013 verdict against Ethicon that resulted in an $11 million award**** to a woman who alleged serious injury from her implant.
