Transvaginal Mesh Lawsuit News: Federal Plaintiff Allowed to Pursue Claims Related to Use of Prolene in Ethicon Mesh Products, Bernstein Liebhard LLP Reports

the claims similarly allege that the company’s pelvic mesh products used in the treatment of pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured, and caused recipients to suffer a wide variety of painful, and sometimes permanent, vaginal mesh complications. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is a member of the Plaintiffs’ Steering Committee in the federal Ethicon litigation. Court records indicate that more than 60,000 transvaginal mesh lawsuits have been filed against several manufacturers in the Southern District of West Virginia. Mr. Grand is serving on the Plaintiffs’ Steering Committee for a number of these proceedings, including: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187).

Mr. Grand is also serving as Co-Liaison Counsel in a second Ethicon litigation underway in New Jersey’s Atlantic County Superior Court, where court documents indicate well over 5,000 transvaginal mesh lawsuits have been filed. Mr. Grand also served on the Plaintiff's team in the proceeding’s first trial of an Ethicon claim. That case concluded in March 2013, when the Plaintiff was awarded more than $11 million for injuries she suffered from Prolift mesh. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-1)

In addition, Mr. Grand has been named Co-Liaison Counsel in a second litigation underway in Atlantic County Superior Court for lawsuits involving C.R. Bard products. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)

Women who were allegedly harmed by transvaginal mesh may be entitled to compensation for their medical bills, lost wages, pain and suffering, and other damages.
