Transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuitclaims.com/ ) continue to move forward in two consolidated litigations underway in New Jersey’s Atlantic County Superior Court, Bernstein Liebhard LLP reports. According to a notice on the Court’s website, the next Case Management Conference in the proceedings established for vaginal mesh lawsuits involving products manufactured by Ethicon, Inc. and C.R. Bard, Inc. will be convened on December 6, 2013 at 10:00 a.m. Court records indicate that 4,500 complaints have been filed in New Jersey on behalf of women who suffered serious injuries allegedly associated with Ethicon devices. Another 912 lawsuits have been filed on behalf of alleged victims of transvaginal mesh complications linked to C.R. Bard products. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10; In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
“We continue to hear from women who suffered serious and life-changing complications, allegedly due to products manufactured by these two defendants. We are pleased to see these cases moving forward, and look forward to additional progress in the year to come,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is representing numerous women in the New Jersey litigations, where Firm partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel for both proceedings. The Firm continues to offer free legal evaluations to alleged victims of vaginal mesh complications associated with devices marketed by C.R. Bard, Ethicon and other companies.
Transvaginal Mesh Lawsuits
According to the U.S. Food & Drug Administration (FDA), the most common transvaginal mesh complications include mesh erosion through vaginal tissue, infection, pain, and urinary problems. In a July 2011 alert, the FDA warned that there had been a five-fold increase in such injuries reported to the agency. At the same time, the FDA also modified its stance on the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair, stating that it no longer considered the problems to be rare.
This past March, the nation’s first trial involving an Ethicon vaginal mesh lawsuit concluded in the New Jersey litigation, with the jury awarding $3.35 million in compensatory damages, plus $7.76 million in punitive damages, to a woman who experienced transvaginal mesh complications associated with the Gynecare Prolift device. Bernstein Liebhard LLP partner, Jeffrey S. Grand, served on the trial team for the case. (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey).
Mr. Grand is also a member of the Plaintiffs’ Steering Committees in four vaginal mesh litigations now underway in U.S. District Court, Southern District of West Virginia: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”).
Women who have allegedly been harmed by transvaginal mesh may be entitled to compensation for their medical bills, pain and suffering, and other injuries.
