Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Settlement of C.R. Bard Vaginal Mesh Lawsuit in New Jersey State Litigation

C.R. Bard has reached a settlement in a transvaginal mesh lawsuit (http://www.meshrecall.com/) filed in New Jersey’s Atlantic Superior Court on behalf of a woman who suffered vaginal mesh complications, allegedly due to the company’s Avaulta Plus device, Bernstein Liebhard LLP reports. According to court documents, the case was scheduled to go to trial on September 23, 2013, and would have been the first bellwether trial in a multicounty litigation established in Atlantic County for vaginal mesh lawsuits involving Avaulta mesh products. Bard case to go to trial in the multidistrict litigation underway in West Virginia Federal Court. Vaginal Mesh Lawsuits
Court documents indicate that more than 800 vaginal mesh lawsuits have been filed against C.R. Bard in the New Jersey proceeding. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10) According to a report from Bloomberg.com, the Plaintiff in the newly-settled case, a 56-year-old-teacher from Colorado, had undergone three corrective surgeries after allegedly suffering mesh erosion from an Avaulta Plus device. The terms of the settlement reached in her transvaginal mesh lawsuit have not been disclosed.*

According to Bloomberg.com, C.R. Bard is named in more than 8,000 vaginal mesh lawsuits pending in courts around the country. In addition to the claims pending in New Jersey, court documents indicate that C.R. Bard is named in more than 4,600 vaginal mesh lawsuits that have been filed in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. On August 15, 2013, the jury hearing arguments in the litigation’s first bellwether trial awarded $2 million in compensatory and punitive damages to a woman who suffered vaginal mesh complications associated with the Avaulta Plus device. According to court documents, an undisclosed settlement was reached a week later in the transvaginal mesh lawsuit scheduled for the proceeding’s second trial. (In re C.R. Bard Inc. In July 2012, a California Superior Court jury hearing arguments in the nation’s first C.R. Bard vaginal mesh trial ordered the company to pay $3.5 million of a $5.5 million judgment awarded to another Avaulta Plus recipient. The Plaintiffs’ doctor was ordered to pay the remainder of the award. (Scott v. Kannappan, S-1500-CV-266034-WDE, Superior Court for Kern County, California (Bakersfield))

Court records indicate that thousands of additional transvaginal mesh lawsuits have been filed against other manufacturers of pelvic mesh in separate multidistrict litigations underway in the Southern District of West Virginia, including: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327. Mr. Grand is also serving on the Plaintiffs’ Steering Committees for each of these federal litigations.

At the state level, Mr. Grand has been named Co-Liaison Counsel in a second consolidated proceeding underway in Atlantic County Superior Court for vaginal mesh lawsuits involving Ethicon’s Gynecare pelvic mesh products. He was also a member of the trial team for the proceeding’s first Ethicon trial, which ended in March with an $11 million damage award to the Plaintiff.
