Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Settlement of C.R. Bard Vaginal Mesh Lawsuit in New Jersey State Litigation

C.R. Bard has reached a settlement in a transvaginal mesh lawsuit (http://www.meshrecall.com/) filed in New Jersey’s Atlantic Superior Court on behalf of a woman who suffered vaginal mesh complications, allegedly due to the company’s Avaulta Plus device, Bernstein Liebhard LLP reports. According to court documents, the case was scheduled to go to trial on September 23, 2013, and would have been the first bellwether trial in a multicounty litigation established in Atlantic County for vaginal mesh lawsuits involving Avaulta mesh products. (Virgil v. C.R. Bard Inc., ATL-L6917-10)

“This is the second transvaginal mesh lawsuit settled by C.R. Bard in the past several weeks, and follows a finding for the Plaintiff in the first C.R. Bard case to go to trial in the multidistrict litigation underway in West Virginia Federal Court. Vaginal Mesh Lawsuits
Court documents indicate that more than 800 vaginal mesh lawsuits have been filed against C.R. Bard in the New Jersey proceeding. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10) According to a report from Bloomberg.com, the Plaintiff in the newly-settled case, a 56-year-old-teacher from Colorado, had undergone three corrective surgeries after allegedly suffering mesh erosion from an Avaulta Plus device.
