Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Judge’s Decision to Uphold Verdict in First Federal Trial of C.R. Bard Vaginal Mesh Lawsuit
Date:10/22/2013

New York, New York (PRWEB) October 22, 2013

As transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuitclaims.com/) move forward in courts around the country, Bernstein Liebhard LLP notes that a federal judge has rejected a bid by C.R. Bard, Inc. to vacate the $2 million verdict awarded to the Plaintiff in the first federal trial of an Avaulta vaginal mesh lawsuit. According to an Order filed in U.S. District Court, Southern District of West Virginia on October 18, 2013, U.S. District Judge Joseph R. Goodwin determined that the evidence submitted at trial was sufficient to allow a reasonable jury to conclude the Avaulta Plus pelvic mesh device the Plaintiff received in 2009 was defectively designed, and that C.R. Bard failed to provide doctors with adequate warnings about its risks. (Cisson v. C.R. Bard Inc., 11-cv-00195, U.S. District Court, Southern District of West Virginia (Charleston))

“Our Firm has been monitoring this case very closely, as the claims put forth by the Plaintiff echo the allegations made by many of our own transvaginal mesh lawsuit clients,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. Firm partner Jeffrey S. Grand, is a member of the Plaintiffs’ Steering Committee in the federal C.R. Bard litigation. Bernstein Liebhard LLP continues to offer free legal evaluations to women who allegedly suffered serious vaginal mesh complications following implantation of devices manufactured by C.R. Bard, Inc., as well as American Medical Systems, Inc., Ethicon, Inc. and Boston Scientific Corp.

Vaginal Mesh Lawsuits
According to court documents, C.R. Bard is facing more than 5,000 transvaginal mesh lawsuits in the Southern District of West Virginia, all of which allege its Avaulta products caused women to suffer painful vaginal mesh complications, including mesh erosion, chronic pain, infection, and scarring. (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187) The Plaintiff at the center of its first bellwether trial, which concluded in August, was forced to undergo multiple corrective procedures after she began suffering pain, bleeding and bladder spasms. Among other things, she alleged that C.R. Bard used a certain type of plastic resin in its Avaulta products, despite knowing it was not meant for permanent implantation in humans.

Court records indicate that the case was the second loss at trial for C.R. Bard. In July 2012, a California Superior Court jury ordered the company to pay $3.6 million of a $.5.5 million judgment after it determined C.R. Bard was partly responsible for vaginal mesh complications suffered by another Avaulta Plus recipient. The woman’s surgeon was found liable for the remainder of the judgment. (Scott v. Kannappan, S-1500-CV-266034-WDE, Superior Court for Kern County, California (Bakersfield))

The federal C.R. Bard litigation is just one of six consolidated proceedings underway in the Southern District of West Virginia for transvaginal mesh lawsuits. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees for the following federal litigations: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.

Mr. Grand was also named Co-Liaison Counsel in two multicounty litigations established for C.R. Bard and Ethicon mesh lawsuits in New Jersey’s Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March with an $11 million verdict for the Plaintiff. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10; In re: Pelvic Mesh Litigation/Bard, No. L-6339-10).

Women who may have been harmed by pelvic mesh devices used to treat pelvic organ prolapse or stress urinary incontinence may be entitled to file a vaginal mesh lawsuit seeking compensation for their injury related damages.
