The second bellwether trial of a federal transvaginal mesh lawsuit (http://www.transvaginalmeshlawsuitclaims.com/ ) involving C.R. Bard Inc.’s Avaulta line of pelvic mesh devices has been postponed. According to documents filed in the U.S. District Court, Southern District of West Virginia, the Plaintiff in the case sought a continuance after one of her expert witnesses unexpectedly became unavailable. The trial, which was supposed to begin this morning, has been put on hold indefinitely. (Jones v. C. R. Bard, Inc. 2:11-cv-00114)

Transvaginal Mesh Lawsuits
The case scheduled for trial in West Virginia is one of more than 6,200 involving C.R. Bard that have been consolidated in that jurisdiction for pretrial proceedings. According to court documents, the proceeding’s first bellwether case concluded in August, with the jury awarding $2 billion in damages to the Plaintiff. Court records further indicate that what was to have been the litigation’s second bellwether trial settled on the day the trial was set to begin, while the third case set for a bellwether trial was voluntarily dismissed by the Plaintiff. On the state level, one vaginal mesh lawsuit involving a C.R. Bard Avaulta device did conclude in July 2012. The Plaintiff was awarded $5.5 million by a California Supreme Court jury, which ordered C.R. Bard to pay a $3.6 million portion of the judgment. The doctor who implanted the woman’s Avaulta mesh device was ordered to pay the remainder. (Scott v. Kannappan, S-1500-CV-266034-WDE, Superior Court for Kern County, California (Bakersfield))
