Transvaginal Mesh Injury Lawsuits: C.R. Bard Trial Delayed One Month, Rottenstein Law Group LLP Reports

The fourth C.R. Bard transvaginal mesh bellwether trial was postponed to Jan. 10, 2014, about one month after its initially scheduled start date, according to court documents. The vaginal mesh firm Rottenstein Law Group LLP, which maintains vaginal mesh website, notes that the plaintiff filed a transvaginal mesh injury lawsuit against Bard over its Avaulta mesh product.

Carolyn Jones received the mesh implant to treat her pelvic organ prolapse, according to court documents (2:11-cv-0114; U.S. District Court for the Southern District of West Virginia).

“Postponing a trial is not rare, especially at the end of the calendar year,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “There is a lot of pretrial preparation that occurs, and sometimes that takes extra time. And the holiday season typically causes rescheduling of court business.”

Of the three previous Bard mesh injury bellwether lawsuits, two had outcomes in which the plaintiff received some kind of compensation. In the first, on Aug. 15, 2013, a jury awarded plaintiff Donna Cisson about $2 million in damages, according to court documents (Cisson v. C. R. Bard, Inc., 2:11-cv-00195; U.S. District Court for the Southern District of West Virginia). In the second trial, which occurred a week later, plaintiff Wanda Queen settled out of court for an undisclosed sum, according to court documents (Queen et al v. C. R. Bard, Inc., 2:11-cv-00012; U.S. District Court for the Southern District of West Virginia). A third scheduled trial was canceled when the plaintiff dismissed her lawsuit.

Bard, along with AMS, Coloplast, Cook Medical and Boston Scientific, is a major device manufacturer in the consolidation of federal transvaginal mesh cases which is considering settling tens of thousands of lawsuits, according to a Sept. 30 Bloomberg article.*
