The Society for Advanced Spinal Intervention Comments on Landmark Case, Calls for Standards in Minimally Invasive Spine Surgery

In the latest developments of the “Spine Turf Wars,” a lawsuit has been filed at the Superior Court of New Jersey Law Division- Bergen County (Docket No. BDS 08959-2012 N) which will be instrumental in giving clear guidelines by which physicians and surgeons are able to perform minimally invasive spine surgery. The Society for Advanced Spinal Intervention believes that lawsuit will determine solid requirements for surgeries involving spinal intervention.

“The central issue [in the case] relates to the definition of the standard required for training and credentialing physicians who perform outpatient, minimally invasive spine surgery,” states Dr. Richard Kaul, M.D., the plaintiff in the case.

In order to accommodate for the increasing numbers of pain physicians who are able to perform minimally invasive spinal surgery, Professor Solomon Kamson, President of the Society for Advanced Spinal Intervention, has developed specific guidelines, known as The Rule of Five, which will allow for both neurosurgeons and interventional pain physicians to perform minimally invasive spine surgeries using the same protocol.

For a procedure to be defined as minimally invasive spine surgery, it must meet the following criteria:
1. Fluoroscopic guidance and interpretation.
2. Minimal muscle dissection.
3. Must qualify for outpatient.
4. Minimal blood loss (150 cc).
5. Time from completion of surgery to discharge of less than 12 hours.

Travelling across the country to testify on behalf of Dr. Kaul, Dr. Kamson claims that this definition will be a great step forward for the medical profession, allowing for the creation of policy and regulations which will allow for fair competition between surgeons and pain physicians in the performance of minimally invasive spine surgery. The refined definition will clarify techniques which are currently used to perform the procedure.

With the completion of the trial, Dr. Kaul intends to devote his time to The Spine Africa Project, http://www.spineafricaproject.org, a US-based 501 c 3 charity begun in 2008.
