Wolf & Pravato (Fort Lauderdale), Alters Law Firm (Miami) and Morelli Ratner (New York) last month filed the first two state and national class actions in the federal courts (United States District Court For The Southern District of Florida, Case Number: 9:12-cv-80516-KAM, Judge Kenneth A. Marra, United States District Judge) against Demilec (USA), LLC, (the designer, manufacturer, distributer and seller of a SPF named “Demilec Sealection 500”), as well as Masco Corporation, who claims they are the world’s largest manufacturer of brand name products for the home improvement and home construction segments.

Wolf & Pravato, Alters Law Firm and Morelli Ratner have come together to create a formidable legal team to once again take action to protect consumers and their families from the effects of sprayed polyurethane foam insulation (SPF). SPF is being manufactured, marketed, distributed, sold and installed into thousands of homes nationwide despite allegations that the product is defective, dangerous and harmful.

SPF is formed during an onsite polymerization reaction of a monomer containing at least two isocynate functional groups (usually a diisocynate --- MDI or TDI, or a polymeric isocynate) with a monomer containing at least two hydroxyl (alcohol) groups called polyol with catalysts and a blowing agent. SPF is formed by reacting the A-side (isocynates) with the B-side (polyol plus the other additives). The Environmental Protection Agency, other federal agencies, states, industry and other countries have taken action to address risks posed by exposure to isocynates like those found in the A-side. The “other additives” found in the B-side have been known to include chlorinated TRIS, a flame retardant removed in 1979 from children’s sleepwear and completely banned by New York this year from any children’s products because studies show it can mutate DNA, cause harm to the developing brain, disrupt hormones and cause cancer. The State of California’s Carcinogen Identification Council has determined TRIS to be a carcinogen.

Homes containing SPF often have a slight fish-like odor some find to be almost a “new home, chemical smell.” Tests have shown that off-gassing can occur with scary results, including the presence of abnormal levels of formaldehyde. High exposure to SPF, including vapors, aerosols and dust during and after installation can cause asthma, lung damage, other respiratory and breathing problems, and skin and eye irritation. Once sensitized, people have found it virtually impossible to continue residing in the home with SPF, and removal of the product has been extremely difficult and can even make the matter worse because of the particularization that can occur during the removal process.
