The Federal Trade Commission Files Lawsuit Seeking an Injunction Against Marketer of Weight-loss Products Over Alleged False Advertising, Parker Waichman LLP Reports

Parker Waichman LLP, a national law firm dedicated to protecting the rights of consumers, is informing the public that The Federal Trade Commission (FTC) has filed a lawsuit to obtain an injunction against the marketer of HCG Platinum weight-loss products, alleging the company uses false consumer advertising to convey the impression that its products are capable of bringing about the swift loss of substantial amounts of weight. The lawsuit was filed on Oct. 30, 2013, in U.S. District Court, District of Arizona (Case No. 2:13-cv-02215). Kevin Wright, HCG Platinum LLC and Right Way Nutrition LLC have been named defendants.

The weight-loss products marketed by the defendants contain HCG (human chorionic gonadotropin), a hormone in human placenta that “for decades has been falsely promoted by various marketers for weight loss,” according to the FTC’s Complaint. Products containing this hormone have already been in the spotlight as part of a combined effort between the FTC and the U.S. Food and Drug Administration (FDA), according to the Complaint, which further noted that in November 2011 the two agencies jointly sent warning letters to seven marketers of products that contained HCG – a group that included current defendant Kevin Wright. The warning letter revealed that the products offered by those marketers were actually mislabeled drugs in violation of sections of the Federal Food, Drug, and Cosmetic Act, and also illegal, based on the FTC Act, which renders illegal any weight loss claims not supported by reliable scientific evidence, according to the Complaint.

“The weight-loss business is rife with companies using unsupported marketing claims to promote what are usually lose-weight-quick products or schemes that don’t work,” said Gary Falkowitz, Managing Attorney at Parker Waichman LLP. “This is a consumer product category where the old adage ‘if it seems too good to be true, it probably is’ certainly fits.” Parker Waichman is currently evaluating cases for a pending class action lawsuit.

Marketing claims—featured on both packaging and in advertising—are a major concern, the Complaint said, noting that the marketers of the HCG Platinum line make various claims, including:

  •     Consumers will lose a pound or two per day for several weeks, for a total of up to 127 pounds;
  •     The products are safe and have been clinically proven to burn fat and reduce weight; and
  •     The products also can lower cholesterol.
