Date:5/18/2013

Columbus, OH (PRWEB) May 18, 2013

The product liability attorneys at Wright & Schulte have filed ten Skechers lawsuits on behalf of consumers nationwide who have sustained serious tendon injuries allegedly caused by the defective design of Shape-Ups toning shoes. These cases are all part of MDL 2308 and were all filed on March 18, 2013. These Skechers lawsuits will be heard in the U.S. District Court of the Western District of Kentucky, Louisville Division.

Wright & Schulte, LLC specializes in defending the rights of those who have suffered severe injuries after using products with defective or dangerous designs. Allegations of Skechers Tendon Damage Injuries
According to the complaints for all of these Skechers Injury Lawsuit, the plaintiffs had been allegedly wearing their Shape-Ups while performing their daily activities when the inherently unstable rocker bottom of the shoe caused them to strain, tear or otherwise damage the tendons in various parts of their bodies.

Five of the ten plaintiffs represented in these Skechers lawsuits include a Texas women who tore various tendons in both of her feet and eventually needed surgery on her right foot (case no. 3:13-cv-00338-TBR); another Texas woman who stretched tendons in her right leg and had seriously trained her right Achilles tendon (case no. 3:13-cv-00332-TBR); a Tennessee woman who tore her Achilles tendon and had to undergo surgery to try to repair her allegedly painful Skechers injury (case no. 3:13-cv-00351-TBR); a Massachusetts woman who sustained a serious tear to her right Achilles tendon and was, as a result, forced to undergo ankle surgery (case no. 3:13-cv-00343-TBR); and an Oklahoma woman who suffered from torn tendons in both of her knees and, as a result, had to undergo multiple knee surgeries (case no. 3:13-cv-00335-TBR).

The other five plaintiffs in these Skechers lawsuits allege that they sustained severe tendon damage within their feet allegedly due to Skechers use. These plaintiffs include a Michigan woman who tore a tendon in her left foot and, as a result, had to undergo surgery (case no. 3:13-cv-00348-TBR); a Nevada man who developed severe tendonitis in his feet that required surgery (case no. 3:13-cv-00341-TBR); and a Georgia woman (case no. 3:13-cv-00342-TBR), a Louisiana woman (case no. 3:13-cv-00333-TBR), and a Mississippi woman (case no. 3:13-cv-00334-TBR) who all developed a condition known as plantar fasciitis, in which strained tendons in the bottom of the feet cause painful inflammation of the foot’s connective tissues.

Misleading Skechers Ads Costs Company $40M
The complaints for these Skechers lawsuits content that the plaintiffs purchased Shape-Ups after being swayed by various ads that highlighted the alleged health benefits of these toning shoes (including that they improved muscle tone and helped wearers get in shape without going to the gym). However, an independent study overseen by the American Council on Exercise (ACE) and first published in June 2010 found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf ][June 2010]

According to a May 2012 article in the Washington Post, Skechers was legally ordered to pay $40 million for intentionally misleading consumers in its Shape-Ups advertising. As part of this ruling, the court also found that Skechers failed to alert consumers about the possible risks associated with these toning shoes and that Skechers had not performed sufficient safety testing on Shape-Ups.
