A panel of federal judges will soon consider whether or not federally-filed Stryker hip replacement lawsuit claims should be consolidated before a single federal judge for pretrial proceedings. According to a notice posted on the website for the U.S. Judicial Panel for Multidistrict Litigation (JPML), Oral Arguments will be heard on the matter on May 30th in Louisville, Kentucky. Stryker Hip Recall
Stryker recalled its Rejuvenate and ABG II hip stems in July 2012, after the metal components were found to be prone to fretting and corrosion at the modular neck junction. According to the Stryker hip recall notice, this occurrence could cause recipients to suffer pain and adverse local tissue reactions, as well as the need to have the hip replaced. Stryker has advised affected patients to undergo blood tests for elevated metal ion levels and cross sectional imaging to ensure their hips are functioning properly, even if they have not experienced symptoms described in the recall notice.*
Court documents show that dozens of Stryker hip replacement lawsuits are currently pending in various federal courts. Some plaintiffs have requested that the proposed multidistrict litigation be established in U.S. District Court, District of Minnesota, where the most claims are pending. Other plaintiffs have requested the lawsuits be transferred to the Northern District of Illinois.
According to court records from New Jersey, at least 145 Stryker hip recall claims have also been filed in a consolidated litigation underway in Bergen County Superior Court.
