The next Status Conference in the New Jersey Stryker hip lawsuit litigation underway in New Jersey Superior Court is scheduled to begin tomorrow morning at 10:00 a.m., Bernstein Liebhard LLP reports. Court records indicate that at least 145 Stryker hip recall claims have been filed in the proceeding on behalf of individuals who allegedly suffered metallosis, necrosis, osteolysis and other serious injuries related to the July 2012 recall for Stryker Rejuvenate and ABG II Modular-Neck Hip Stems. Stryker Hip Recall
The Stryker hip recall was announced in July 2012, after the Rejuvenate and ABG II hip stems were found to be prone to fretting and corrosion at the modular neck junction. Stryker has advised recipients of Rejuvenate and ABG II hip stems to undergo blood tests for elevated metal ion levels and cross sectional imaging to ensure the components are functioning properly, even in the absence of symptoms.* The Company also announced in January that it has partnered with third-party claims administrator, Broadspire Services Inc., to manage reimbursement requests from patients seeking compensation for out-of-pocket costs related to the Stryker hip recall.** However, Bernstein Liebhard LLP continues to advise potential claimants to seek legal advice before discussing their case with a Broadspire representative, as any information disclosed during the Broadspire Stryker claims process could be used later as evidence in a Stryker Rejuvenate lawsuit.

Substantial progress has already been made in the Stryker hip lawsuit litigation underway in New Jersey Superior Court. In an Order issued on April 2nd, Judge Brian R. Martinotti set forth procedures for the parties to begin selecting cases to move toward early mediation. However, his order stipulated that the case against Stryker will continue while mediation takes place.
