Stryker Hip Lawsuit News: Those Considering Filing Lawsuits Need to Heed Statutes of Limitation, Rottenstein Law Group LLP Reports

A recent ruling in the U.S. District Court for the Eastern District of New York underscores the importance of paying attention to the statutes of limitation that might apply to Stryker hip claims. The Rottenstein Law Group LLP manages a website at http://www.strykerhipreplacementlawsuit.net that features information on the side effects associated with a Stryker hip replacement and details how to determine eligiblity to file a lawsuit.

In 2012 plaintiff Maryann Guisto filed a lawsuit against device manufacturer Stryker over its Trident hip implant, after initially identifying pain from the implant in 2006 but waiting to get revision surgery until 2011, according to court records in Guisto, et al. v. Stryker Corp., et al. (Case No. 12-cv-2489, U.S. District Court for the Eastern District of New York). Judge Jack B. Weinstein ruled on June 4 that even though the revision surgery was performed in 2011, the earlier discovery in 2006 of pain associated with the hip implant means that a 2012 suit runs afoul of the applicable three-year statute of limitation.

“It is important for those looking to file a Stryker hip lawsuit to assess carefully their options as soon as they feel their implant has harmed them,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “Keeping accurate records is a must.”

The Trident is not the only Stryker hip implant to be the subject of lawsuits. The company recalled its metal-on-metal ABG II and Rejuvenate systems in 2012 because data showed that the modular necks of those devices are prone to fretting and corrosion, which can cause the patient’s tissue around the implant to swell and become painful, according to the company’s website.* Alleged serious side effects also include metallosis, which is the poisoning of the body with metal particles in the blood.
