Stryker Hip Lawsuit News: Bernstein Liebhard LLP Reports on Recent Case Management Conference in New Jersey Stryker Hip Recall Litigation

Stryker hip lawsuit claims filed on behalf of alleged victims of last year’s Rejuvenate and ABG II Modular-Neck Hip Stem recall continue to move forward in New Jersey Superior Court, Bernstein Liebhard LLP reports. According to court documents, a Case Management Conference was held in the Stryker hip recall litigation on May 15th, at which time the Court, among other things, set deadlines by which Plaintiffs with cases now pending in the litigation must submit Fact Sheets to Defendant and Liaison Counsel. The Court also scheduled the Stryker hip litigation’s next Case Management Conference for June 18, 2013. (In re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296)

Stryker Hip Recall
The Stryker hip recall was announced in July 2012, after the Rejuvenate and ABG II hip stems were found to be prone to fretting and corrosion at the modular neck junction. The Company has advised recipients of Rejuvenate and ABG II hip stems to undergo blood tests for elevated metal ion levels and cross sectional imaging to ensure the components are functioning properly, even in the absence of symptoms. According to Stryker, some 20,000 Rejuvenate and ABG II hip stems were sold prior to the announcement of the Stryker hip recall.*

Court documents indicate that at least 145 Stryker hip lawsuits have already been filed in the New Jersey litigation. Plaintiffs allege that metal particles shed from the Stryker hip replacements caused local tissue reactions manifesting with pain and/or swelling, and other adverse outcomes including metallosis, necrosis and osteolysis. Last month, Bergen County Superior Court Judge Brian R. Martinotti set forth procedures for the parties to begin selecting Stryker hip lawsuits for early mediation. However, his order stipulated that the case against Stryker will continue while mediation takes place.

Plaintiffs in federally-filed Stryker hip lawsuits have petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) to establish a consolidated proceeding for those claims in a single federal court.
