Stryker hip lawsuit claims filed in the wake of the July 2012 Rejuvenate and ABG II Modular-Neck Hip Stem recall have been consolidated in a multidistrict litigation and transferred to the U.S. District Court, District of Minnesota for pretrial proceedings, Bernstein Liebhard LLP reports. A Transfer Order issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on June 12, 2013 encompasses 41 Stryker hip replacement lawsuits initially filed in 16 federal jurisdictions. The Panel noted that it was aware that an additional 110 potentially-related Stryker hip recall claims are also pending in various federal district courts. According to the Transfer Order, U.S. District Judge Donavan W. Frank has been tapped to preside over the Stryker litigation in Minnesota. Stryker Hip Lawsuits
The Stryker hip recall was announced in July 2012, after post-market surveillance data indicated the Rejuvenate and ABG II hip stems were likely to suffer from fretting and corrosion at the modular neck junction. According to Stryker’s recall notice, recipients of these hip components may be at risk for pain, swelling and adverse local tissue reactions, as well as the need to have the hip replaced. Stryker has advised all affected patients, even those who have not experienced any symptoms associated with a failing hip, to undergo blood tests for elevated metal ion levels and cross sectional imaging to ensure their Rejuvenate and ABG II stems are functioning properly.*
In January, the New Jersey Supreme Court ordered the transfer of all Stryker hip replacement lawsuits involving Rejuvenate and ABG II components filed in that state to Bergen County Superior Court for coordinated case management. Court documents indicate that 161 Stryker hip recall claims are now pending in the New Jersey litigation. In April, Bergen County Superior Court Judge Brian R. Marinetti set forth procedures for the parties to begin selecting cases for early mediation. However, his order stipulated that the case against Stryker will continue while mediation takes place.
