Status Conference Scheduled for December in Federal Ethicon Transvaginal Mesh Lawsuit Litigation, More than 10,270 Gynecare Cases Now Filed in Proceeding

Ethicon further allege their failure to adequately warn about the potential for side effects from use of their pelvic mesh products, which plaintiffs claim were defectively designed.

A total of six tranvaginal mesh lawsuit proceedings are currently pending in the Southern District of West Virginia. In addition to his active role in the federal Ethicon proceeding, Mr. Grand is also a member of the Plaintiffs’ Steering Committees for the following federal litigations: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187.

At the state level, court documents indicate that 4,400 vaginal mesh lawsuits have been filed in a multicounty litigation established in New Jersey’s Atlantic County Superior Court. Mr. Grand is currently serving as Co-Liaison Counsel for this consolidated Ethicon proceeding, and was a member of the Plaintiffs’ trial team for its first vaginal mesh lawsuit trial, which concluded in March 2013 with an $11 million damage award to the Plaintiff.
