A recent order issued in the federal Ethicon transvaginal mesh lawsuit (http://www.transvaginalmeshlawsuithelp.com/) litigation indicates that its next status conference will be held in December, Bernstein Liebhard LLP reports.

According to a Scheduling Order announced on October 23rd, matters related to lawsuits filed in a proceeding underway in the U.S. District Court, Southern District of West Virginia will be discussed at a joint status conference on December 5th at 12:00 p.m. Recent court documents indicate that 10,270 lawsuits have been filed in the federal proceeding over Gynecare products marketed by the Johnson & Johnson subsidiary, Ethicon Inc. Transvaginal Mesh Lawsuits

Transvaginal mesh lawsuits filed in the federal Ethicon litigation allege injuries caused by Ethicon’s line of Gynecare pelvic mesh products, which have been associated with mesh erosion, chronic pain, infection and organ damage. According to the lawsuits, these transvaginal mesh complications are often only repairable through corrective surgery to remove the implant. Claims filed against Ethicon further allege their failure to adequately warn about the potential for side effects from use of their pelvic mesh products, which plaintiffs claim were defectively designed.

A total of six tranvaginal mesh lawsuit proceedings are currently pending in the Southern District of West Virginia. In addition to his active role in the federal Ethicon proceeding, Mr. Grand is also a member of the Plaintiffs’ Steering Committees for the following federal litigations: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187.

At the state level, court documents indicate that 4,400 vaginal mesh lawsuits have been filed in a multicounty litigation established in New Jersey’s Atlantic County Superior Court. Mr. Grand is currently serving as Co-Liaison Counsel for this consolidated Ethicon proceeding, and was a member of the Plaintiffs’ trial team for its first vaginal mesh lawsuit trial, which concluded in March 2013 with an $11 million damage award to the Plaintiff.
