Specialty Technical Publishers (STP) and Specialty Technical Consultants (STC) Publish Environmental, Health & Safety (EHS) Audit Protocol for Thailand

Specialty Technical Publishers (STP) and Specialty Technical Consultants (STC) announce the availability of the newly updated International Audit Protocol Consortium (IAPC) EHS audit protocol for Thailand. Highlights of selected legislation covered in the newly developed protocol include:

  • The “Notification of the Ministry of Industry Re: Determining the Contamination Criteria in Soils and Underground Water, Preparation of Report on the Results of Underground and Underground Water Quality Monitoring and Control Measures to Reduce Contamination in Soils and Underground Water B.E. 2559 (2016) November 29, 2016” covers various requirements regarding control of contamination including the following: preparation of a report proposing measures to control soil and groundwater contamination; observation of wells for determination of contamination; mapping of locations of observation wells and chemical storage, etc.; and creation of a standards table for soil and groundwater contamination contingencies in the factory area.
  • “Ministerial Regulation (No. 25) B.E. 2559 (2016) Issued Under the Factory Act B.E. 2535 (1992), December 30, 2016” was issued under the “Factory Act B.E. 2535” and regards the prohibition of expansion of all type or sizes of factories within the area of 100 meters from the public water source, except for the factories which improve the quality of waste, including the community wastewater or the expansion of factory that has adequate treatment system of the factory.
  • “Ministerial Regulation Re: Establishment of Health Hazardous Business B.E. 2560, August 4, 2017” prescribes criteria, methods, and measures of control for the establishment of businesses that are harmful to health. This regulation also repeals the “Ministerial Regulation Re: Prescribing Standards, Procedures and Measurements for Control of a Business Dangerous to Health B.E. 2545.”
  • “Notification (No. 4) of Ministry of Natural Resources and Environment Re: Rules, Procedures, and Guidelines for the Preparation of Reports for Environmental Impact Assessment of Projects or Businesses that May Cause Impact on the Community, Environmental Quality, Natural Resources and Health B.E. 2560 (2017), September 18, 2017” repeals the “Notification of the Ministry of Natural Resources and Environment Re: Prescribing Criteria, Methodology, Practices and Guidelines for the Preparation of Environmental Impact Assessments for Projects or Activities which May Cause Severe Impacts on Natural Resources, Environmental Quality or Health in the Community (2009);” the “Notification Re: Preparation of Environmental Impact Assessments for Projects or Activities which May Cause Severe Impacts to Natural Resources, Environmental Quality or Health in the Community (No. 2) B.E. 2553 (2010);” and the “Notification of the Ministry of Natural Resources and Environment, Re: Rules, Procedures and Regulations Environmental Impact Assessment Report for Projects or Companies that may have Serious Impact on the Community as a Whole, Natural Resources and Health (No. 3) B.E. 2555 (2012), dated April 24, 2012.”
  • “Notification of the Ministry of Natural Resources and Environment Re: The Type and Size of the Project or Activities which Must Submit EIA and the Rules, Procedures and Guidelines for Preparing the EIA (No. 11), B.E. 2560 (2017) November 28, 2017” amends the “Notification of the Ministry of Natural Resources and Environment Re: Types and Sizes of Projects or Activities of a Government Agency, State Enterprise or Private Person for which Reports on Environmental Impact Assessments are Required (2012).” This Notification revises and updates the list of the types and sizes of projects or activities for which EIAs must be prepared.
  • “Enhancement and Conservation of National Environmental Quality Act (No. 2) B. E. 2561 (2018) April 19, 2018” has been introduced as an Amendment to the “Enhancement and Conservation of National Environmental Quality Act B.E. 2535, April 4, 1992.” This Amendment prescribes requirements for preparation of EIA of project/business that may affect the environment/natural resources/health/quality of life.
  • “Notification of the Department of Industrial Works Re: Guidelines for Approving the Import of HCFCs for Domestic Use (No. 2) B.E. 2559 (2016), December 9, 2016” replaces the details attached in the “Notification of the Department of Industrial Works Re: Guideline for Approving the Import of HCFCs for Domestic Use B.E. 2555 (2012)” with new details prescribing the import quota for hydrochlorofluorocarbons (HCFCs) and the phase-out of such substances by 2583 (2040).
  • “Notification of Ministry of Industry Re: Factories prohibits the use of HCFC-141b (dichloro-fluoro ethane) in the foam production process, B.E. 2560 (2017), June 30, 2017” specifies that no factories shall use HCFC-141b (dichloro-flouro-ethane) or Polyphenols containing HCFC-141b (dichloro-flouro-ethane) in any foam production processes, except for the injection molded foam and spray foam. This Notification is issued in accordance with Factory Act B.E.2535 (1992).
  • “Notification of the Ministry of Industry Re: Disposal of Wastes or Unusable Materials (No. 2) B.E. 2560 (2017), July 25, 2017” amends the “Notification Re: Disposal of Wastes or Unusable Materials B.E. 2548.” The Notification informs that the application for license or authorization for disposal of waste or unused materials in factories can be made through electronic system.
  • “Notification of the Department of Industrial Works Re: Rules, Procedures and Conditions to apply for Permits for the Disposal of Waste or Unusable Materials Out of the Factory Premises, through Electronic System, B.E. 2560 (2017), August 3, 2017” sets out the requirements for applications for the License/Permits through electronic system, for disposal of waste and unusable material outside the factory.
  • “Notification of the Department of Industrial Works Re: Rules, Procedures and Conditions to apply for Permits for the Disposal of Waste or Unusable Materials Out of the Factory Premises, through Electronic System, (No. 2) B.E. 2561 (2018), February 20, 2018” specifies the requirements for applications in reference to the “Notification of Department of Industrial Works dated August 3, 2560 (2017)” and extends the date to apply for the License/Permits through electronic system, for disposal of waste and unusable material outside the factory premises, until 30 April 2018.
  • “Notification of the Department of Industrial Works Re: Rules, Procedures and Conditions for Obtaining Permits for the Disposal of Waste or Unusable Materials Out of the Factory Premises, through Electronic System B.E. 2561 (2018) April 18, 2018” prescribes the rules, procedures, and conditions to obtain permission through electronic system, for disposal of the waste or unusable materials outside the factory premises.
  • “Notification of the Department of Industrial Work Re: Determining the Type of Waste or Unusable Materials and Methods of Disposal and Permission to Dispose of Unused Waste Outside the Factory Premises, by Automatic Transmission through Electronic System, B.E. (2018), April 26, 2018” lists the types of waste or unusable material and its disposal method, and requires the factory to obtain authorization to dispose waste and unusable material outside the factory premises through an electronic system.
  • “Notification of Department of Industrial Work Re: Certification through Automatic/Electronic system, for Treatment and Disposal of Waste or Unusable Materials outside the Factory Premises, B.E. 2561 (2018), April 26, 2018” describes the certification procedure through automatic/electronic system, for factories that dispose of waste and unusable material outside factory premises.
  • “Notification of the Ministry of Industry Re: Exemption from Permission to Dispose of Non-Hazardous Waste or Unusable Materials outside the Factory, B.E 2561 (2018), June 1, 2018” exempts factories from the requirement to obtain permission to dispose of non-hazardous waste or unusable material outside the factory premises. This Notification lists the codes for the exempt and non-hazardous types of waste or unusable materials, which is included in Appendix 4-F.
  • “Notification of Department of Industrial Work Re: Cancellation of the Rules and Procedures about the Permit for Disposal of Scrap and Plastics Material (Used or Not in Use) Imported in the Kingdom of Thailand B.E. 2551, B.E. 2561(2018) August 7, 2018” cancels the “Notification of the Department of Industrial Works Re: Rules, Procedures and Permission for the Disposal of Scrap and Unused Plastics, (Used or Not Used) in the Territory of the Kingdom of Thailand, dated January 28, 2008.”
  • “Notification of the Ministry of Industry issued under the Factory Act B.E. 2535 Re: Standardization of Wastewater Discharge from Factories, B.E. 2560 (2017) June 7, 2017” repeals the “Notification of the Ministry of Industry No. 2 B.E. 2539 and establishes new pollution discharge limits for wastewater from factories and defines analytical methods for evaluating wastewater quality.”
  • “Ministerial Regulation Re: Oil Tank and Maintenance of Oil Tank, B.E. 2560 (2017) October 12, 2017” sets out the requirements for testing and maintenance of oil storage tanks in facilities where the capacity of such tank is 2,500 liters or more.
  • “Ministerial Regulation Re: Test of Underground Storage Tanks by Other Methods, B.E. 2560 (2017) November 30, 2017” prescribes the methodology and standards for testing of underground storage tanks.
  • “Ministerial Regulation Re: Establishment of Health Hazardous Business B.E. 2560, August 4, 2017” prescribes the criteria, methods, and measures for control establishments of businesses that are harmful to health.
  • “Ministerial Regulation B.E. 2561 (2018) Re: Radiation Safety, October 5, 2018” describes radiation safety measures for protection of the public and environment from radiation exposure.
  • “Ministerial Regulation B.E. 2561 (2018) Re: Radiation Security October 5, 2018” describes radiation security measures for the radioactive material, for the protection of the public and environment from radiation exposure.
  • “Notification of the Department of Energy Business Re: Rules and Methods for Installation, Testing and Inspection of Protection Systems and Fire Extinguishing Systems B.E. 2561, August 27, 2018” prescribes the firefighting and fire suppression systems for the storage of Liquid Petroleum Gas (LPG) cylinders.
  • “Notification of Department of Labor Protection and Welfare Re: Rules and Procedures for Establishing Hearing Conservation Measures in Establishments B.E. 2561, June 12, 2018” prescribes the requirements with regard to hearing conservation in workplace.
  • “Notification of the Ministry of Industry Re: List of Hazardous Substances No. 4 B.E. 2561 (2018), January 11, 2018” amends the list of hazardous substances published by the Ministry of Industry in 2013 by further including new hazardous substances.
  • “Notification of Department of Labor Protection and Welfare Re: Concentration Limit of Hazardous Substances B.E. 2560 August 3, 2017” prescribes the concentration limits of hazardous chemicals in workplace as required under the “Ministerial Regulation Re: Prescribing Administration, Management and Implementation Standards for Occupational Safety, Health and Environment Related to Hazardous Chemicals B.E. 2556 (2013), Clause 28.”
