Skechers Stress Fracture Lawsuits Filed on Behalf of Six Consumers Who Suffered Stress Fractures While Wearing Skechers Shape-Ups, Wright & Schulte LLC Reports

Wright & Schulte LLC, an experienced product liability law firm, has filed six new Skechers stress fracture lawsuits on behalf of consumers who suffered stress fractures, allegedly due to the rocker-bottom sole design of Skechers Shape-Ups toning shoes. The Skechers injury lawsuits were filed on January 28, 2013, in the federal Skechers Toning Shoes Products Liability Litigation (MDL 2308), now underway in U.S. District Court, Western District of Kentucky. According to the complaints, Skechers Shape-Ups were introduced in 2009, and quickly became the market leader in the toning footwear category. Consumers, including the six Plaintiffs being represented by Wright & Schulte LLC, were induced to pay as much as $100/pair by advertising that touted the benefits of toning shoes. This advertising, which prominently featured celebrity endorsers including Kim Kardashian, Joe Montana, Karl Malone and Brooke Burke, promised Skechers Shape-Ups would enable the wearer to “Shape Up While You Walk,” and “Get in Shape without Setting Foot in a Gym.” In May 2012 Skechers USA agreed to pay $40 million to settle charges brought by the Federal Trade Commission (FTC) that the company deceived consumers by making unfounded claims that Shape-Ups would help people lose weight, and strengthen and tone their buttocks, legs and abdominal muscles. While the FTC settlement provided consumers with refunds for the purchase of their shoes, it did not include compensation for injuries allegedly caused by Skechers Shape-Ups. http://www.ftc.gov/opa/2012/05/consumerrefund.shtm

All of the individuals being represented by Wright & Schulte LLC suffered stress fractures after wearing Skechers Shape-Ups in the course of normal, daily activities. According to one complaint, a Michigan woman sustained a stress fracture in her left foot after wearing her Shape-Ups for approximately six months (Case No. 3:13-cv-00173-TBR). A second lawsuit filed by a Hilliard, Ohio woman claims that a stress fracture in the her right foot that required surgery was the result of the Skechers Toning Shoes she wore for eight months (Case No. 3:13-cv-00165-TBR). A Tennessee woman represented by the Firm alleges her Skechers Shape Ups caused her to suffer a stress fracture on her right knee (Case No. 3:13-cv-00163-TBR).

An Indiana woman claims that wearing Skechers Toning Shoes resulted in two stress fractures in her left leg, and a potential stress fracture in the right. After wearing an orthopedic boot, she required surgery on her left knee (Case No. 3:13-cv-00184-TBR). A lawsuit filed on behalf of a Georgia woman claims a stress fracture in her left foot that required a leg brace was caused by the Skechers Shape-Ups she wore for two years (Case No. 3:13-cv-00161-TBR). And finally, a Cleveland, Ohio woman claims Skechers Toning Shoes were to blame for the stress fracture she sustained in her right leg (Case No. 3:13-cv-00177-TBR).

All of the complaints allege that Skechers Shape-Ups are defective due to their rocker bottom sole, which altered the Plaintiffs’ gait and caused severe lateral instability. They further allege that the toning shoes provide no additional health benefits than do regular athletic and walking shoes. An independent study commissioned by the American Council on Exercise concluded: “There is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” The lawsuits also point out that as of May 2011, Consumer Reports has documented that Skechers has seen more reports of injuries or complaints than any other product in its database.
