Skechers Lawsuit filed by Wright & Schulte on Behalf of Woman Who Suffered Multiple Ankle Fractures Due to the Purportedly Unstable Rocker Bottom Design of Shape-Ups

Wright & Schulte LLC has filed another Skechers lawsuit against the makers of Shape-Ups. This Skechers lawsuit, filed on behalf of an Ohio woman (Case No. 3:13-cv-00453-TBR), was filed is part of MDL 2308 and was file in the U.S. District Court of the Western District of Kentucky, Louisville Division. This Skechers lawsuit alleges that the unstable rocker bottom design of Shape-Ups caused the plaintiff to fall, fracture her left ankle in multiple places and require long-term medical care to treat her Skechers injuries. This lawsuit also contends that Skechers intentionally misrepresented the safety and effectiveness of Shape-Ups in its advertising for these toning shoes.

Skechers Lawsuit Contends Flawed Rocker Bottom Design Causes Ankle Fractures

According to court documents for this Skechers lawsuit (Case No. 3:13-cv-00453-TBR), the plaintiff purchased her Shape-Ups in September 2010. Within a year of regularly wearing her Shape-Ups, the plaintiff was walking when the unstable rocker bottom of one of her shoes turned inwards, causing her to left ankle to buckle and her to fall in excruciating pain. Immediately after her fall, the plaintiff sought medical care.

After getting x-rays, the plaintiff was told that she had sustained multiple fractures in her left ankle and that she would have to undergo surgery to repair these fractures. Following surgery, the plaintiff had to wear a wrap for six weeks, a cast for eight weeks and a walking boot for one year. After wearing the boot, the plaintiff also underwent extensive physical therapy. While such extensive medical treatments prevented the plaintiff from being able to earn a living for more than one year, they also have not fully restored the plaintiff’s strength in and use of her left ankle.

In addition to alleging that Shape-Ups’ defective design caused the plaintiff’s serious injuries, this Skechers lawsuit also contends that the plaintiff had originally purchased Shape-Ups due to the alleged health benefits touted in the various ads for these toning shoes. Specifically, while Skechers ads claimed that wearing these shoes could improve muscle tone in the legs, buttocks and abdominal muscles, these ads also alleged that regularly wearing Shape-Ups could help consumers improve their circulation and posture.

Class-Action Skechers Lawsuit Targets Misleading Ads

Skechers has come under fire for allegedly misleading consumers into thinking that Shape-Ups could provide health benefits to the wearers of these toning shoes. In fact, this Skechers lawsuit and many others, including a recently settled class-action Skechers lawsuit have alleged that Skechers’ claims about Shape-Ups’ health benefits have not been validated by reliable scientific research. This allegation has been supported by an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin that found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ June 2010]
