Shape-Ups’ Defective Design Causes Arm Fractures, Skechers Lawsuit Alleges
According to court documents (Case No. 3:13-cv- 00446-TBR), the plaintiff purchased her Shape-Ups in April 2010 after being persuaded by various ads that alleged that these shoes could help wearers get in shape without going to the gym. Specifically, in addition to contending that Shape-Ups could improve the muscle tone in wearers’ legs, buttocks and abs, Skechers ads also claimed that regularly wearing these shoes could help consumers improve their circulation and posture.
The Skechers lawsuit further contends, within two weeks of buying and regularly wearing Shape-Ups, the plaintiff fell when the unstable rocker bottom of her Shape-Ups rolled forwards, according to the complaint. The fall caused the plaintiff excruciating pain in her left arm and knee, which led her to seek emergency medical care. After undergoing x-rays, the plaintiff was informed that she had fractured the olecranon and proximal ulna bones in her left arm and that she had sprained her knee. Additionally, physicians informed the plaintiff that she would need to undergo surgery to have a plate and screws implanted in her left arm to treat her serious fractures. Despite the surgery and months of physical therapy, the plaintiff still reportedly has limited use of and constant pain in her injured left arm.
Court documents go on to state that “the health risks of Skechers outweigh the absence of any benefit provided to [individuals who wear Shape-Ups]” and that the defective rocker-bottom design of Skechers Shape-Ups was directly responsible for causing the plaintiff's injuries.
Misleading Shape-Ups Ads Lead to Skechers Lawsuit Settlement
According to court documents, Skechers made various claims about the alleged health benefits of Shape-Ups, and none of these claims has been verified by reliable research. In fact, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf ] [June 2010]
Skechers’ intentional misrepresentation of Shape-Ups’ health benefits has spurred thousands of product liability lawsuits and has cost Skechers millions in settlement awards to consumers. In fact, in May 2013, a federal judge approved a $40 million settlement in a Skechers class-action lawsuit based on more than 500,000 consumer claims that Skechers intentionally misrepresented the safety and effectiveness of Shape-Ups in its advertising. As part of this ruling, the court also found that Skechers is no longer allowed to run ads for its toning shoes.
