Skechers Lawsuit Filed by Wright & Schulte on Behalf of Virginia Man Who Suffered Serious Back Injuries Allegedly Due to Use of Defectively Designed Shape-Ups

This Skechers Injury Lawsuit (case no. 3:13-cv-00324-TBR) was filed on March 18, 2013 and is part of MDL 2308. As with other Skechers lawsuits recently filed by Wright & Schulte, this case will be heard in the U.S. District Court of the Western District of Kentucky, Louisville Division.

Broken Teeth Caused by Toning Shoes’ Unstable Rocker Bottom, Alleges Skechers Lawsuit
Court documents explain that the plaintiff bought his Shape-Ups in March 2012 after seeing various ads alleging the health benefits of these shoes. While Skechers ads claimed that wearers of Shape-Ups could improve the muscle tone of their legs, buttocks and abs, they also contended that wearing these shoes could help consumers get in shape without having to go to the gym.

According to this Skechers lawsuit, within a month of wearing his Shape-Ups on a daily basis, the plaintiff fell when the alleged unstable rocker bottom of one of his Shape-Ups rolled forwards, causing him to lose his balance while walking up a flight of stairs. Upon falling, the plaintiff hit his chin on the handrail of the stairs, which painfully jammed his teeth together and broke four of them. To treat his excruciating oral pain and recover from his alleged Skechers injuries, the plaintiff underwent dental surgery that required his broken teeth to be resurfaced and crowns to be placed on them.

The complaint for this case goes on to contend that “the health risks of Skechers outweigh the absence of any benefit provided to [individuals who wear Shape-Ups]” and that the allegedly defective rocker-bottom design of Skechers Shape-Ups was directly responsible for causing the plaintiff's injuries.

Alleged Skechers Negligence
Despite Skechers claims regarding the alleged health benefits associated with wearing their toning shoes, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ June 2010]

In fact, Skechers misrepresentation of Shape-Ups health benefits has been the basis of thousands of product liability lawsuits filed against the company and has cost Skechers millions in settlement awards to consumers. In May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally mislead consumers in its Shape-Ups advertising. In May of 2012, Skechers settled a lawsuit with the FTC where the court found that Skechers is no longer allowed to run ads for its toning shoes.
