Severe Knee Injury Caused by Shape-Ups’ Defective Design, Skechers Lawsuit Alleges

Court documents for this Skechers lawsuit (Case No. 3:13-cv-00449-TBR) explain that the plaintiff bought her Shape-Ups in May 2010 after being persuaded by various ads alleging that wearing these toning shoes could provide wearers with various health benefits. In addition to claiming that Shape-Ups could help tone leg, buttocks and abdominal muscles, Skechers ads also alleged that regularly wearing Shape-Ups could help consumers improve their circulation and posture.

The complaint goes on to detail that, within about one year of regularly wearing Shape-Ups, the plaintiff began experiencing severe pain in her left knee. Upon seeking medical care and undergoing an MRI, the plaintiff was told that she has sustained at least two tears to the meniscus on her left knee. Although the plaintiff had received injections in her injured knee, the unrelenting pain and persistent injury ultimately required her to undergo two knee surgeries in October 2011 and January 2013, respectively. Despite these surgeries and physical therapy, however, the plaintiff still reportedly has constant pain in and limited use of her left knee.
