Skechers Lawsuit Filed by Wright & Schulte Alleges that a Virginia Woman Sustained a Serious, Painful Knee Injury Due to the Dangerous Design of Shape-Ups

This Skechers Lawsuit (Case No. 3:13-cv-00449-TBR), which is part of MDL 2308, was filed on April 29, 2013 in the U.S. District Court of the Western District of Kentucky, Louisville Division.

Severe Knee Injury Caused by Shape-Ups’ Defective Design, Skechers Lawsuit Alleges

Court documents for this Skechers lawsuit (Case No. 3:13-cv-00449-TBR) explain that the plaintiff bought her Shape-Ups in May 2010 after being persuaded by various ads alleging that wearing these toning shoes could provide wearers with various health benefits. In addition to claiming that Shape-Ups could help tone leg, buttocks and abdominal muscles, Skechers ads also alleged that regularly wearing Shape-Ups could help consumers improve their circulation and posture.

The complaint goes on to detail that, within about one year of regularly wearing Shape-Ups, the plaintiff began experiencing severe pain in her left knee. Upon seeking medical care and undergoing an MRI, the plaintiff was told that she has sustained at least two tears to the meniscus on her left knee. Although the plaintiff had received injections in her injured knee, the unrelenting pain and persistent injury ultimately required her to undergo two knee surgeries in October 2011 and January 2013, respectively. Despite these surgeries and physical therapy, however, the plaintiff still reportedly has constant pain in and limited use of her left knee.

Skechers Lawsuit Settlement: $40 Million Awarded to Consumers

In addition to alleging that Shape-Ups’ defective design was responsible for the plaintiff’s serious injuries, this case also contends that Skechers’ claims about the alleged health benefits of Shape-Ups have not been backed up by reliable scientific research. In fact, an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ June 2010]

These allegations that Skechers’ has misrepresented the safety and effectiveness of Shape-Ups’ have sparked thousands of lawsuits and have cost Skechers millions in settlements to consumers throughout the U.S. In fact, in May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on more than 500,000 consumer claims that Skechers intentionally misrepresented the health benefits of Shape-Ups in its advertising. In his ruling, the judge also ordered Skechers to stop running misleading ads for its toning shoes.
