Skechers Lawsuit Filed By Wright & Schulte LLC Alleges Unstable Design of Skechers Shape-Ups Caused a Tennessee Woman to Sustain Severe, Painful Knee Injuries

ased her Shape-Ups and eventually sustained injuries due to wearing these shoes. According to the complaint, the plaintiff bought her Shape-Ups in November 2010 and about two years later fell while wearing these shoes due to the shoe’s unstable rocker bottoms. Because the fall caused her to severely twist her left knee, the plaintiff sought medical attention, at which time she was told that she had torn her left meniscus. Upon her diagnosis, the plaintiff was also told that she would need to undergo surgery to treat her serious knee injury.

The case further detials that after undergoing surgery in February 2013, the plaintiff continued treatment for her Skechers knee injury with physical therapy. Despite such treatments, however, the plaintiff still reportedly has regular pain in and limited use of her left knee.

Class-Action Skechers Lawsuit Settlement

While this Skechers lawsuit alleges that Shape-Ups’ defective design caused the plaintiff’s serious injuries, it also contends that the plaintiff had originally purchased Shape-Ups due to the alleged health benefits touted in the various ads for these toning shoes. Specifically, while Skechers ads claimed that wearing these shoes could improve toning in the legs, buttocks and abdominal muscles, these ads also alleged that regularly wearing Shape-Ups could help consumers improve their circulation and posture.

However, as the complaint alleges, Skechers’ claims about Shape-Ups’ health benefits have not been validated by reliable scientific research. In fact, an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf June 2010]
