Skechers Knee Injuries
According to one complaint filed by a woman from Bessemer, Alabama (Case No. 3:13-cv-00093, the plaintiff was walking on a flat surface when the rocker bottom of one of her Shape-Ups rolled inwards, severely twisting her knee. Upon seeking medical attention, the plaintiff was informed that she had torn her meniscus and would need surgery; although she underwent surgery to try to repair her torn mensicus, the plaintiff has been living with constant pain since sustaining her Skechers knee injury.
In Case No. 3:13-cv-00092, a Chicago, Illinois woman is alleging that she suffered a medial meniscus tear in her left knee due to regularly wearing Shape-Ups for about 10 months. The plaintiff had to undergo surgery and extensive physical therapy in an effort to treat her Skechers knee injury.
Skechers Lawsuits Continue to Rise Even after $40 Million Settlement with FTC
Since their debut in 2009, Shape-Ups have been advertised by Skechers as having a number of health benefits for wearers, including that these toning shoes can allegedly improve circulation and muscle tone, increase the loss of body fat and help wearers get in shape without having to go to the gym. However, an independent study overseen by the American Council on Exercise (ACE) called these claims into question, finding that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ http://www.acefitness.org/getfit/studies/toningshoes072010.pdf
Skechers was initially held legally responsible for its misleading Shape-Ups advertising in May 2012 when the company was required to pay the Federal Trade Commission $40 million. As part of this Skechers settlement, the court also found that Skechers was negligent in warning consumers about the possible risks associated with these toning shoes and that Skechers had not perform sufficient safety testing on Shape-Ups.
